These Terms of Service (“Terms”) govern your access to and use of TradeVoiceServices (“TradeVoice,” “we,” “us”), a service operated by Rebeiz Holdings LLC. By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms.
1. The Service
TradeVoice is an AI-powered phone answering and appointment booking service for service businesses. We provide a dedicated phone number that answers inbound calls using artificial intelligence, books appointments into your connected calendar, and sends email and SMS confirmations to your customers and to you.
2. Eligibility
You must be at least 18 years old and have the authority to enter into contracts on behalf of your business to use the Service. The Service is intended for legitimate, licensed service businesses operating in the United States.
3. Acceptable Use
You agree not to use the Service to:
- Engage in unlawful, deceptive, or fraudulent activity.
- Misrepresent your identity, affiliation, or licensure.
- Make outbound calls, robocalls, or unsolicited communications.
- Use the Service for emergency dispatch as a substitute for 911. The Service is not designed for emergency response.
- Reverse engineer, decompile, or attempt to extract our models, prompts, or proprietary technology.
- Resell or white-label the Service without a written agreement.
4. Subscription, Billing, and Cancellation
4.1 Plans
TradeVoice is offered on a monthly subscription basis at the prices published on our pricing page. Subscriptions renew automatically each month unless cancelled. All fees are charged in advance and are non-refundable except as described in Section 4.3.
4.2 Payment
Payments are processed by Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis. You are responsible for keeping your payment information current.
4.3 7-Day Satisfaction Window
If you are not satisfied within seven (7) days of your first subscription charge, contact us at gabriel@tradevoiceservices.com and we will refund the first month in full. After the 7-day window, fees are non-refundable.
4.4 Cancellation
You may cancel at any time from your dashboard or by emailing us. Your service remains active through the end of the current billing period; you will not be charged thereafter.
5. AI Disclaimer
The Service uses large language models, speech-to-text, and text-to-speech systems. AI systems may produce errors, misunderstand callers, or occasionally miss a booking. While we make every effort to maintain high accuracy, you acknowledge that:
- The AI may misinterpret caller intent or capture details incorrectly.
- The AI is not a replacement for human judgment on emergencies, complex medical or safety situations, or legally significant communications.
- You are responsible for reviewing call logs and bookings.
- We are not liable for lost business resulting from AI errors, missed bookings, or system downtime.
6. Call Recording and AI Disclosure
The Service records and transcribes calls answered through your dedicated TradeVoice number. Several U.S. states (including California, Florida, Pennsylvania, and Illinois) require two-party consent for call recording and AI disclosure. You are responsible for informing your callers — for example, in your outgoing voicemail or on your website — that calls may be handled by an AI assistant and may be recorded. We provide a configurable opening greeting that can include this disclosure.
7. Data Ownership and Privacy
You own all data your customers provide through calls to your TradeVoice line, including transcripts, contact information, and booking details. We process this data on your behalf to provide the Service. Our handling of personal information is governed by our Privacy Policy.
8. Third-Party Services
The Service relies on third-party providers including Twilio (telephony and SMS), Google (calendar), Deepgram (speech recognition), ElevenLabs (text-to-speech), Groq (language model inference), SendGrid (email), Stripe (payments), and Supabase (data storage). These providers operate under their own terms; we are not responsible for outages, errors, or changes to their services.
Connecting Google Calendar is optional and is governed by Google's own terms of service. Our handling of data we receive from Google is described in the “Google User Data and Limited Use” section of our Privacy Policy.
9. Service Availability
We strive for high uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance, address security issues, or experience outages outside our control. We are not liable for revenue lost during downtime.
10. Intellectual Property
TradeVoice retains all rights to the Service, including software, prompts, models, voice profiles, UI designs, and trademarks. You receive a limited, non-exclusive, non-transferable license to use the Service for the duration of your subscription. You retain all rights to your business name, customer data, and any content you provide.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEVOICE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless TradeVoice, Rebeiz Holdings LLC, and its officers, employees, and agents from any claims, damages, or expenses arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) the content of any communications handled through your TradeVoice number.
13. Termination
We may suspend or terminate your access to the Service at any time for material breach of these Terms, abuse of the Service, illegal activity, non-payment, or a request from law enforcement. On termination, your right to use the Service ends immediately. You may export your call logs by emailing us within 30 days of termination.
14. Modifications
We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in San Diego County, California.
16. Text Messaging and Customer Consent
The Service sends transactional text messages — appointment confirmations and reminders, and new-booking notifications — through your dedicated number. Recipients may reply STOP at any time to opt out and HELP for assistance; message and data rates may apply, and message frequency depends on your appointment volume.
You are responsible for ensuring a lawful basis and any required consent to call and text the individuals who contact your business through the Service, in compliance with the Telephone Consumer Protection Act (TCPA), CTIA messaging principles, and applicable carrier requirements. You agree to use the Service only to send appointment-related, transactional messages to people who have engaged your business to schedule a service, and not to send marketing, promotional, or unsolicited messages. You will not use the Service to message recipients who have opted out. You agree to indemnify us for any claims arising from your failure to obtain any required consent (see Section 12).
